Important information about the processing of personal data by Clinique La Prairie
This Privacy Policy (hereinafter referred to as the "Privacy Policy") sets out the principles and processes applicable to the collection and processing of personal data through the websites of Clinique la Prairie SA and its various entities (hereinafter referred to as the "Entities", hereinafter together referred to as "CLP" or "we").
By browsing our websites, you agree to this Privacy Policy. If you do not agree, please do not use our websites.
This Privacy Policy sets out CLP's policy on the collection, use and protection of your personal data.
We invite you to read carefully the following text published by CLP. It contains important information about the processing of Personal Data by CLP and its Entities and the rights granted to any identified or identifiable natural person whose data is processed, i.e. the data subjects.
Please note that none of your personal data will be sold to third parties and your personal data will not be shared with or made available to third parties, except as provided for in this Privacy Policy.
1. General
1.1. This Privacy Policy applies to the websites of CLP, its Entities and its medical centre (the "Websites").
1.2. More specifically, this Privacy Policy applies regardless of the means or medium used to access one of the aforementioned Websites and sets out the conditions under which, during browsing, CLP collects, uses and retains information concerning data subjects (cf. art. 3 below), as well as the choices that data subjects have regarding the collection, use and disclosure of such information.
1.3. CLP's privacy practices, as described in this Privacy Policy, comply with the Federal Data Protection Act of 25 September 2020 (DPA) and the EU's General Data Protection Regulation (GDPR) 2016/679.
1.4. This Privacy Policy also applies to dedicated pages on social networks and to all services provided in connection with CLP's activities.
1.5. The main purpose of this Privacy Policy is to inform users of the Websites, and any other persons with whom CLP has a relationship, of the principles and procedures applicable to the collection and processing of any information that may identify them.
1.6. By accessing any of the Websites or by contracting with CLP, you acknowledge that you have read, understood and agree to be bound by the terms of this Privacy Policy.

3. Categories of data subjects whose personal data may be processed
In the course of its business, CLP may process the personal data of the following categories of data subjects:
a. A natural person having a contractual relationship with CLP or a natural person in contact with CLP before entering into a contractual relationship with CLP, for example :
- Client of health-related programmes ;
- Medical Centre patient ;
- Potential customer (hereinafter referred to as the "Prospect") ;
- CLP employee or applicant.
b. A natural person connected with CLP or a Prospect (hereinafter referred to as the "Connected Person"), for example :
- Director or member of the board of directors of a legal entity.
c. A natural person who does not have a contractual relationship with CLP, but who is in contact with CLP for other reasons or about whom CLP collects information, for example :
- Social media user commenting on CLP;
- Journalists ;
- Any person contacting CLP for any reason whatsoever.
4. Categories of personal data collected
4.1. Personal Data refers to any data that identifies a person or that, together with other information, makes it possible to identify a person.
4.2. The following are examples of Personal Data that may be collected by CLP:
- Identity: first name, surname, date of birth, gender, etc.
- Contact details: postal address, e-mail address, telephone number, etc.
- Invoicing: amount and due date of invoices, reminders, supporting documents, etc.
- Correspondence: e-mail exchanges, telephone reports, letters, etc.
- Technical data: IP address, MAC address, timestamp, etc.
- Financial situation: credit cards, etc.
- Medical data: height, weight, medical questionnaire data, etc.
4.3. More specifically, here are the main personal data collected by CLP according to the source of the data:
4.3.1 When browsing the Websites. See the cookies policy. The following data may be collected by CLP when browsing the Websites:
a. Navigation data :
When you browse one of the Websites, CLP may collect the following information about you:
- Your IP address ;
- The date and time of your visit;
- Browser used ;
- The brand of equipment you use to connect;
- Socio-demographic data: country, age categories, gender, etc.
b. Contact data (in particular via a contact form and/or newsletter subscription):

This may include basic data relating to your account (for example: name, e-mail address, gender, date of birth, city of residence, profile photo, user ID, list of friends, etc.) and any other information or activity that you authorise the third-party social network to share.

4.3.2. As a CLP customer. When you are a CLP customer, the following data may be collected by CLP:
a. Identification data: when you contract with CLP, we may collect information that identifies you, such as :
- Your first and last name ;
- Your postal address ;
- Your e-mail address ;
- Your telephone number.
b. Financial data: CLP may also collect financial information about you, such as :
- Your bank details.
4.3.3. As a patient of the CLP Medical Centre. When you are a patient of the CLP medical centre, the following data may be collected:
a. Identification data: when you are a CLP patient, we collect information that identifies you, such as :
- Your first and last name ;
- Your postal address ;
- Your e-mail address ;
- Your telephone number.
b. Financial data: CLP may also collect financial information about you, such as :
- Your bank details.
c. Medical data: CLP may also collect medical information about you, such as :
- Size ;
- Weight ;
- Data from the medical questionnaire.
5. Sources used to collect data
5.1. Personal data is collected by CLP in the course of its activities, prior to entering into a contractual relationship and for the duration of the contractual relationship with the person concerned.
5.2. CLP uses various methods to collect personal data, including :
- Direct interactions: CLP generally collects personal data about data subjects directly from them.
- Automated technologies or automated interactions: if a data subject interacts electronically with CLP, for example through one of its websites, CLP may automatically collect personal data using cookies or similar technologies. For more information on cookies, please consult CLP's cookie policy (see link). The following situations may lead to data being processed by CLP:
- Subscribe to a newsletter via the footer or a pop-up window;
- Filling in an online contact form;
- Fill in the "Book the programme" form via a pop-up window;
- Using the online diagnostic tool ;
- The completion of information relating to the user of the press room ;
- Completing your personal account.
- Third parties or publicly available sources: to the extent permitted by law, CLP also collects personal data about data subjects from public sources such as the Internet, print media, electronic media, social media, social networks, commercial registers or other public services, public authorities. With regard to candidates for recruitment, CLP also collects information provided, for example, by recruitment agencies.
6. Purposes of processing data
CLP processes personal data in accordance with the legal provisions in force. Personal data is processed for one of the purposes indicated below or for any purpose connected with and/or incidental to one of the purposes mentioned below, or for any purpose for which the personal data was provided to CLP, or any other instruction given by the data subject.
Not all purposes of use apply to all users.
a. Necessity of data processing for the conclusion or performance of a contract with CLP
Personal data is processed by CLP for the purpose of executing a contract concluded between CLP and the data subject. Personal data is also processed by CLP prior to the conclusion of a contract with the data subject, in order to take steps - at the request of the data subject - to enter into a contractual relationship.
The contracts concerned may, for example, fall into the following categories:
- Hotel services ;
- Contracts with third parties, such as communications agencies, web developers, etc.
- Healthcare supply and services ;
- Employment contracts and other staff contracts.
b. Compliance with CLP's legal obligations
CLP processes personal data in order to meet its legal obligations.
c. Legitimate interests pursued by CLP or a third party
- CLP processes personal data in order to (i) safeguard its legitimate/superior interests or (ii) the legitimate/superior interests of third parties (e.g. Entities) in accordance with applicable local legislation.
- The above-mentioned legitimate/superior interests include, among others:
- Compliance with the legal obligations defined in national and/or international law and in national regulations issued by the competent national supervisory authorities;
- Reporting potential criminal acts or threats to public security to the competent authorities, including by transmitting relevant personal data;
- The transmission of personal data within CLP for internal administrative purposes;
- Defending CLP's interests in the event of civil, administrative, criminal or regulatory complaints or disputes;
- Analysis of market trends and competitive positioning;
- Analysis of the needs, development, expectations and behaviour of the data subject, including the creation of profiles, for the purposes of personalising and improving the quality of communication and interaction with the data subject;
- The development, improvement and analysis of products, services and communications;
- Monitoring and improving e-mail communication and marketing;
- Maintaining relations with journalists;
- Advertising, marketing and sales activities to develop CLP's business.
d. Consent of the data subject to the processing of his/her data
In some cases, personal data may only be processed if the data subject has given CLP his/her consent to the processing of said data.
In accordance with legal provisions, the Data Subject's consent may, for example, be required if CLP is to process special categories of personal data, such as data concerning the Data Subject's health, or if the Data Subject is to participate in automated decisions.
Where it is necessary to obtain consent for the processing of personal data, the data subject will be informed personally by CLP.
Consent to the processing of personal data granted by a data subject may be revoked by the data subject at any time. Any such revocation will be valid only for the future and will not apply retroactively to the processing of personal data carried out prior to the declaration of revocation.
7. Retention of personal data
We process and store your personal data for as long as is necessary for the performance of our contractual and legal obligations or for the purposes for which the data is processed, i.e., for example, for the duration of the business relationship (from the start of a contract to the end of the period covered by its performance) and beyond, in accordance with legal retention and documentation obligations. As soon as your personal data is no longer required for the purposes mentioned above, it is generally deleted or anonymised as far as possible.
8. Categories of recipients of data
Personal data relating to a data subject is disclosed by CLP in accordance with the legal provisions in force.
CLP may need to disclose personal data to the following persons / parties:
a. CLP Personnel: CLP has taken appropriate technical and organisational measures to ensure that Personal Data is disclosed only to those personnel (e.g. employees and auxiliaries) who are responsible for fulfilling, on behalf of CLP, the contractual and/or legal obligations to which CLP is subject in connection with the disclosure of Personal Data. Personnel to whom personal data is disclosed are contractually bound by the applicable legal obligations of confidentiality.
b. Its Entities.
c. Contractual partners: CLP works with partners (e.g. to operate the Websites) in order to provide you with the services set out in the contracts binding us to you.
We take the necessary measures to ensure that the data in question is protected, in particular by means of contracts signed by these partners in which they undertake to protect personal data by means of appropriate security measures.
d. Service providers: CLP works with various partners who enable us to process certain data and carry out certain activities.
These include IT service providers, address verification services, debt collection services, transport companies, advertising agencies, cleaning services and financial service providers (e.g. banks, insurers, financial intermediaries, online payment services).
These service providers may act on our instructions as subcontractors, as joint controllers if they work directly with us on certain processing operations, or as independent data controllers if we communicate the data to them so that they can process it for their own purposes.
If data that creates a particular risk for the data subjects is communicated, e.g. sensitive data, the data subject will be specifically informed.
e. Third party data processors (outsourcing): CLP may disclose personal data to a third party acting as a data processing service provider for CLP, in the context of delegated and outsourced relationships.
These may, for example, be Entities, other third parties such as providers of customer relationship management services used by the Entities, cloud service providers, IT system providers, email service providers or IT development service providers.
When CLP uses subcontractors, we ensure that they apply technical and organisational security measures at least equivalent to those that CLP puts in place to guarantee the security of the personal data subcontracted.
For example, CLP uses subcontractors and external service providers to :
- Manage and/or maintain the Websites;
- Managing the accounts ;
- Advertising;
- Maintain the CRM.
f. Authorities: When we are obliged to do so by law, when we have the right to do so or when it is in our interests to do so, we communicate your personal data to the Swiss or foreign authorities.
When we communicate your data to recipients who act as sub-contractors, we check whether they also communicate data to third parties and require guarantees for these communications, in particular as regards their necessity and security. Where appropriate, we will restrict the processing of your data by certain of our subcontractors. However, these checks and restrictions may not be implemented in respect of certain recipients acting as independent data controllers, in particular the authorities.
9. Data security and confidentiality
CLP has put in place appropriate security measures (technical and organisational) in accordance with legal requirements and best practice, taking into account the risks involved, to protect your data against accidental or intentional manipulation, loss, destruction, disclosure or unauthorised access.
10. Transmission of personal data abroad
We work with service providers and seres that are not located in Switzerland. We therefore transfer certain personal data to them where this is necessary for the purposes described above and complies with the applicable legal framework.
We also use IT services from foreign providers. We endeavour to store data in Switzerland, but sometimes this is not possible. In such cases, we give preference to countries in the European Economic Area and countries offering an adequate level of protection.

11. Rights of data subjects
Any data subject whose personal data is processed by CLP may exercise, within the limits provided for by the legal provisions in force, the rights set out below with regard to the processing of his/her personal data:
- Right to request information about CLP's processing of personal data;
- Right of access to personal data and right to receive a copy ;
- Right to rectify data :
- Right to have data deleted ;
- Right to request the restriction of data processing ;
- Right to object at any time to the processing of personal data for promotional or advertising purposes;
- The right to object at any time to any further processing, unless, for example, a legal basis or our legitimate interest requires or authorises us to continue the processing;
- Right to indicate at any time that you wish to withdraw your consent to the processing of data for which your consent has been requested
- Right to data portability (for personal data that the data subject has provided to CLP as data controller, where the processing of personal data is based on a contract or on the consent of the data subject ;
- Right not to be subject to a decision based exclusively on automated processing, including profiling;
- The right to lodge a complaint with a supervisory authority if the data subject considers that the processing of his/her personal data breaches the law applicable to him/her.
We will inform you of any conditions or restrictions that may apply to the exercise of your rights.
You can exercise your rights by contacting us directly (see above). We reserve the right to request additional data in order to identify you, in particular by means of a copy of a valid official identity document.
To make it easier to process your request, we would also ask you to state precisely which right(s) you wish to assert, and to what extent.
In order to limit paper waste when you request a copy of your personal data, we will make them available to you in digital format.
In addition, please note that under the applicable legal provisions, we may ask you to make a fair financial contribution (up to a maximum of CHF 300) if your request involves disproportionate effort. You will be informed of this in advance so that you can take a position.
Unless extended in accordance with art. 18 para. 2 OPDo, any request for access to personal data within the meaning of art. 25 LPD will be processed within 30 days of receipt of the request.

CLP reserves the right to modify the content of this Privacy Policy from time to time and at its sole discretion, in particular in the event of legislative developments in the field of personal data processing or changes to the processing of personal data by CLP.

1. What is a cookie?
